⚡️ All employees subject to the provisions of Schedule A must be configured with the special condition tag Early Childhood Services - 48 Week Operation in addition to their employment type and classification tags.

Please see below for an example of how to set up a Full Time employee who is employed in an early childhood service that operates for at least 48 weeks:

10 Hour Day Agreement

The special condition tag 10 Hour Day Agreement is only applicable to employees employed in early childhood services that operate for at least 48 weeks.

A.1.4 of Schedule A sets out that the employer and employee may agree that an employee may be rostered to work up to 10 hours in a day.

📜 A.1.4 Subject to the provisions of clause 5—Individual flexibility arrangements, by agreement between an employer and an employee, an employee may be rostered to work up to a maximum of 10 hours in any one day

The agreement to work up to 10 ordinary hours in a day has been automated in the Educational Services (Teachers) Award Managed Template via the 10 Hour Day Agreement.

Please see the below example for how to configure an employee who has agreed to work up to 10 hours in a day:

When applied to the employee profile, the employee will automatically incur daily overtime after 10 ordinary hours are worked.

RDO Agreement

The special condition tag RDO Agreement is only applicable to full time employees employed in early childhood services that operate for at least 48 weeks.

A.2 of Schedule A sets out a method for woking ordinary hours in such a way where the employee accrues and takes one rostered day off in each period.

The employee must work their ordinary hours and accrue the rostered day off entitlement in accordance with A.2.1 and A.2.2.

📜 A.2.1 The employee will work 152 hours over 19 days in each 4 week period with one rostered day off on full pay in each period.

📜 A.2.2 An employee will accrue 24 minutes for each 8 hour day worked to give the employee an entitlement to take rostered days off.

The conditions of A.2 have been automated in the Educational Services (Teachers) Award Managed Template via the special condition tag RDO Agreement.

⚡️ Employees configured on the RDO Agreement should be set up with a 4 weekly overtime averaging period.

For further details on how to configure the overtime averaging period in Tanda, please see here.

Please see the below example of an employee configured with the special condition tag RDO Agreement:

An employee configured with the special condition tag RDO Agreement will automatically record 24 minutes of RDO accrual in the timesheet:

⚡️ In order for the recorded RDO accrual to export towards the employee's rostered day off entitlement, a unique leave type with the naming Rostered Day Off will need to be set up.

The leave type can then be applied to the timesheet when the employee takes the rostered day off.

For details on how to configure leave types in Tanda, please see here.

In addition an employee configured on the RDO Agreement will also incur overtime when they work more than 19 days in a period.

Paying Above Award

If an employee is paid a base rate higher than the award rate, simply enter the employee's base rate in the overriding hourly rate field highlighted below.

This will override the hourly rate in the Managed Template. Penalties and overtime will be calculated from the overriding hourly rate.

Managing Part Time Employees' Normal Hours

This section is only applicable to part time employees that are subject to Schedule A of the Award.

The Educational Services (Teachers) Award sets out conditions for part time employees when they work in excess of their normal hours.

📜 A.4.1 Overtime rates

...

(b) Despite clause A.4.1(a), part-time employees who agree to work in excess of their normal hours will be paid at ordinary time for up to 8 hours provided that the additional time worked is during the ordinary hours of operation of the early childhood service.

A part time employees normal hours can be managed in Tanda.

Configuring normal hours

The number of normal hours agreed can be entered into the Contracted Weekly Hours field.

Working in excess of the normal hours

A part time employee will incur overtime if they work in excess of the number of the agreed ordinary hours entered in the contracted weekly hours field.

📜 A.4.1 Overtime rates

(a) An employee will be paid overtime for all authorised work performed outside of or in excess of the ordinary or rostered hours at 150% of the minimum hourly rate for the first 3 hours and 200% of the minimum hourly rate thereafter.

For example, a part time employees whose normal hours are set to 15 in the employee profile, will automatically incur overtime in the timesheet when they work in excess of 15 ordinary hours:

Agreement to work additional hours at normal rates

Per A.4.1(b) a part time employee may agree to work up to 8 additional hours in excess of the agreed hours at ordinary rates.

📜 A.4.1 Overtime rates

...

(b) Despite clause A.4.1(a), part-time employees who agree to work in excess of their normal hours will be paid at ordinary time for up to 8 hours...

If a part time employee exceeds the number of hours that have been entered in the contracted weekly hours field, they will incur overtime in the timesheet for working in excess of the agreed normal hours.

If the employee has agreed to work the additional hours at ordinary rates in accordance with A.4.1(b) the shift tag Agreed Additional Normal Hours can be added to the timesheet to record the agreement. The employee will then be paid at ordinary hours for 8 additional hours in excess of their normal hours.

To utilise the Agreed Additional Normal Hours shift tag, you will first have to save it to the profiles of the applicable employees. For further details on how to do this please see here.

Once the tag has been saved from the profile, it will be available to select from the shift tag drop-down.

Please see the below example for how to apply the Agreed Additional Normal Hours shift tag in the timesheet.

This part time employee has agreed to work 15 normal hours each week.

When they exceed 15 hours, all time worked past this will incur overtime:

If the employee has agreed to work additional hours, the Agreed Additional Normal Hours tag can be applied to the timesheet.

The first 8 hours worked past the normal hours will then calculate at ordinary rates. Overtime will then kick in again if the employee exceeds 8 additional hours:

The Agreed Additional Hours tag can also be used in the configuration of a Shift Question as detailed here.

Paying Full Time Employees for their Minimum Contracted Hours

Per clause 10 a full time employee is to be engaged to work an average of 38 ordinary hours per week.

📜 10. Full-time employees

A full-time employee is engaged to work an average of 38 ordinary hours per week.

The Minimum Paid Hours feature in the Educational Services (Teachers) Award Managed Template can be utilised to manage the above requirement.

The Minimum Paid Hours functionality requires that the Contracted Weekly Hours field in the employee profile be populated:

By default the Minimum Paid Hours functionality will be disabled in the Managed Template. If you would like to enable the Minimum Paid Hours feature, please see below for further details.

Enabling the Minimum Paid Hours Feature

To enable the Minimum Paid Hours feature, navigate to the Educational Services (Teachers) Award Managed Template via Time & Attendance > Compliance > Educational Services (Teachers) Award → Manage > Manage Award Conditions → Edit.

The Minimum Paid Hours toggle will be disabled. Click enabled to toggle feature on and select save.

You will then be able to see that the Minimum Paid Hours feature has been enabled from the main page of the Educational Services (Teachers) Award Managed Template under Manage Award Conditions.

Once enabled, the Minimum Paid Hours feature will then automatically top up the timesheet when a full time employee works less than the contracted weekly hours that have been set in the employee profile.

In the below example, the employee has worked 34 ordinary hours in the week. Their minimum contracted hours have been set to 38 hours in the profile.

The Minimum Paid Hours feature has automatically topped up the timesheet to the required 38 ordinary hours for the period.

Breaks

Under the Educational Services (Teachers) Award, employees are entitled to meal breaks.

When you enable the Managed Template, you will also enable the default break rules. The break rules will auto-populate breaks for any staff under the Managed Template.

For further details on the specific break rules that apply to employees on the Educational Services (Teachers) Managed Template, please see below.

School and early childhood teachers

The break rules for school and early childhood teachers have been configured based on the break requirements set out in clause 16.1(a).

📜 16.1 Unpaid meal break

(a) An employer is required to provide an unpaid meal break of not less than 30 consecutive minutes to an employee who is engaged to work for more than 5 hours on a day. Such meal break will start no later than 5 hours after the employee has commenced work on that day.

The default break rules will apply a 30 minute unpaid meal break for shifts longer than 5 hours.

The break rules for school and early childhood teachers can also be viewed by navigating to Time & Attendance > Compliance > Educational Services (Teachers) Award > Breaks > Educational Services (Teachers) Award.

The paid meal break for remaining onsite during a meal break per clause 16.2 is not automated in the Educational Services (Teachers) Award.

16.2 Paid meal break

If a teacher employed in an early childhood service is required to remain on the premises during the meal break they will be entitled to a paid meal break of between 20 and 30 minutes no later than 5 hours after commencing work.

This is due to Tanda not being able to foresee when an employee will be required to remain on the employer's premises during their meal break.

If the manager knows this ahead of time, the roster can be updated to reflect a paid meal break.

If not known ahead of time, the timesheet can be updated to capture the paid meal break.

Teachers in early childhood services operating at least 48 weeks

The break rules in this section are only applicable to employees that are subject to Schedule A.

The break rules for teachers in early childhood services that operate for at least 48 weeks have been configured based on the break requirements set out in A.3.1 of Schedule A.

📜 A.3.1 Meal break

(a) An employer is required to provide a paid meal break of between 20 and 30 consecutive minutes to an employee who is engaged or rostered to work for more than 5 hours on a day. Such meal break will start no later than 5 hours after the employee commenced work on that day.

(b) By agreement with the employer, an employee may leave the premises or elect not to be on call during the meal break. In that case the meal time will not count as time worked and nor will payment be made for that time.

The default break rule configuration will apply a 20 minute paid meal break for shifts longer than 5 hours.

The paid meal break for teachers in early childhood services that operate at least 48 weeks should be counted as time worked.

To ensure the paid meal breaks are included in the calculation of overtime, you will need to enable Paid meal breaks are worked time in the break settings:

For further information on managing and configuring break rules in Tanda, please see the help article Setting up and Managing Automatic Breaks.

Missed Meal Breaks

Missed meal break conditions have been configured in the Educational Services (Teachers) Award Managed Template per A.3.1(c) of Schedule A.

📜 A.3.1 Meal break

...

(c) Where an employee is called back to perform any duties within the centre or the break is interrupted for any reason the employee will be paid 150% of the minimum hourly rate for a minimum of 15 minutes and thereafter to the nearest quarter hour until an uninterrupted break, or the balance of the break, is taken.

If an employee is unable to take an uninterrupted meal break of at least 20 minutes, they will automatically incur a missed meal break penalty until a meal break is taken or the shift ends.

A.3.1(c) sets out that the missed meal break penalty is to be paid for a minimum of 15 minutes and to the nearest quarter hour thereafter. This is not automated in Tanda.
The missed meal break penalty will apply based upon the exact amount of time the break was missed for.

The missed meal break penalty will be paid at 150% of the minimum hourly rate.

In the below example the employee has not taken a meal break and works 7 hours:

Using the Break Rules will assist in automating the rostering of breaks to meet the requirements under the Award.

Proactive alerts can also be set up to be sent to managers during the shift regarding the taking of breaks. These are known as Key Alerts. To find out more about configuring Key Alerts, see Receive alerts for variances and compliance breaches.

For further information on automatic breaks please see the Setting up and managing automatic breaks article in the Help Centre.

Timesheets

Once an employee has clocked time in Tanda, the clocked times will convert to a timesheet.

The clocked time will be interpreted by Tanda based on the employee's employment type and classification.

General Information

An example of interpreted timesheet can be seen below. The employee is a full time school teacher. They have been configured with the Full Time employment type and Teacher - Preschools and Schools Level 1 classification.

For a general overview of timesheets in Tanda see Getting Started: Timesheets.

Minimum Payment Periods

The Educational Services (Teachers) Award stipulates minimum payment periods for casual employees.

Please see below for further information on the specific minimum payment periods that apply to casual employees.

Casual employees in a school

The minimum payments in this section do not apply to casual employees configured with the Early Childhood Services or Early Childhood Services - 48 Week Operation special condition tags.

📜 17.5

(c) Minimum payments

(i) Where a day is the usual required attendance time for an employee at a particular school and a half day is half the usual required attendance time; a casual employee in a school will be paid for a minimum of half a day.

The half day minimum payment will automatically trigger in the timesheet if the employee works less than half a day (3.8 hours).

In the below example, the employee has worked for 2 hours. The minimum payment rules automatically trigger in the timesheet, topping up the shift to the required half day rate:

Casual teachers employed in early childhood services

The minimum payments in this section are only applicable to casual employees configured with the Early Childhood Services special condition tag.

📜 17.5

(c) Minimum payments

...

(ii) A casual employee in a children’s service or early childhood education service will be paid for a minimum of:

  • where they are required to work for up to 2 hours, 2 hours;

  • where they are required to work for more than 2 hours and up to 4 hours, 4 hours; and

  • where they are required for more than 4 hours and up to a full day, the full day rate, based on their appropriate hourly rate.

The applicable minimum payment will automatically trigger based on the number of hours worked by the employee.

For example, when an employee works 3 hours the minimum payment rules will automatically trigger in the timesheet, topping up the shift to the required 4 hour minimum payment:

Casual teachers employed in early childhood services operating for at least 48 weeks

The minimum payments in this section are only applicable to casual employees configured with the Early Childhood Services - 48 Week Operation special condition tag.

📜 17.5

(c) Minimum payments

...

(ii) A casual employee in a children’s service or early childhood education service will be paid for a minimum of:

  • where they are required to work for up to 2 hours, 2 hours;

For example, when an employee works 5 hours the minimum payment rules will automatically trigger in the timesheet, topping up the shift to the required full day rate:

If a minimum payment period applies and the employee has not met the required minimum shift length, the timesheet will automatically buffer to the required length at the rate that would have otherwise applied to the time worked if the employee had worked the minimum payment period.

Breaks Between Periods of Duty

This section is only applicable to shiftwork employees configured with the Early Childhood Services - 48 Week Operation special condition tag.

A.1.5 of Schedule A sets out the required breaks between periods of duty.

📜 A.1.5 Breaks between periods of duty

(a) An employee will be entitled to a minimum break of 10 consecutive hours between the end of one period of duty and the beginning of the next. This applies in relation to both ordinary hours and where overtime is worked.

(b) Where an employer requires an employee to continue or resume work without having a 10 hour break off duty, the employee is entitled to be absent from duty without loss of pay until a 10 hour break has been taken, or be paid at 200% of the minimum hourly rate of pay until released from duty.

Per A.1.5 of Schedule A an employee must receive a break of at least 10 hours between one period of duty and the next.

If an employee is required to continue or resume work without receiving the appropriate break between shifts the employee will be paid at 200% of the minimum hourly rate until they are released from duty.

The break between shifts penalty will be treated as ordinary or overtime based on the conditions that would have otherwise applied to the time worked.

If an employee commences the break between shifts penalty during ordinary hours and subsequently works into a period of overtime, the penalty will continue applying at the penalty rate but the time worked will be captured as overtime.

Please see the below example where the employee has not received the required break between shifts and works in excess of 8 hours in the day.

Saturday and Shiftwork Penalties

This section is only applicable to shiftwork employees configured with the Early Childhood Services - 48 Week Operation special condition tag.

Under the Educational Services (Teachers) Award there are additional penalty periods that apply specifically to employees engaged as shiftworkers as detailed below.

📜 A.5 Shiftwork

A.5.1 For the purposes only of calculating the shift rates provided for clause A.5:

(a) a weekly rate of pay is calculated by dividing the employee’s annual salary, including applicable allowances, by 52.18;

(b) a daily rate of pay is calculated by dividing the weekly rate as provided for in clause A.5.1(a) by 5; and

(c) the rate of pay for a casual is first calculated in accordance with the provisions of clause 17.5.

A.5.2 A shift rate is payable to employees required to perform shiftwork in accordance with the following:

Shift

In Tanda the application of the shiftworker penalties set out in A.5 have been automated.

Please see the below example of the afternoon shift applying in the timesheet:

⚡️ For the shiftwork penalties to apply automatically, the employee must be configured on one of the shiftworker employment types outlined here.

The non-rotating night shift penalty has been automated via the Permanent Night Shift employment types.

Please see the below example of a timesheet for an employee configured with the employment type tag Full Time Permanent Night Shift:

Overtime

Please see below for further details on the overtime conditions facilitated in the Educational Services (Teachers) Award 2020.

School and Early Childhood Teachers

The Educational Services (Teachers) Award does not set out overtime rates for teachers.

The ordinary hours of work for teachers are set out in clause 15. Time worked outside of the ordinary hours of work will calculate as non-ordinary in the timesheet but will be paid at the employee's normal hourly rate.

Managing the average ordinary hours

The ordinary hours of an employee under this award may be averaged over a 12 month period.

15.3 Notwithstanding the NES, and due to the operational requirements of employers in the industry, the ordinary hours of an employee under this award may be averaged over a 12 month period.

⚡️ Clause 15.3 can be managed in Tanda via the overtime averaging settings. For further details on how to update the overtime averaging settings in your account, please see here.

If the employee exceeds an average of 38 hours per week in their averaging period, the hours worked will calculate as non-ordinary in the timesheet and will be paid at the employee's normal hourly rate.

Managing the maximum attendance days

Clause 15.5 sets out that the maximum number of days an employee can be required to attend during term weeks and non-term weeks is 205 days in each school year.

15.5 The maximum number of days that the employee will be required to attend during term weeks and non-term weeks is 205 in each school year.

The Managed Template contains automated conditions that will indicate when the employee works more than 205 days in a school year in the timesheet.

⚡️ The functionality that is used to automate this provision requires the employee's overtime averaging period to align with the school year.

If the employee works more than 205 days in the school year, any excess days worked will calculate as non-ordinary in the timesheet and will be paid at the employee's normal hourly rate.

Clause 15.6(c) sets out circumstances an employee may be required to work but should not contribute to the calculation of total attendance days for the school year.

15.6 The following circumstances are not included when calculating the 205 employee attendance days:

(a) co-curricular activities that are conducted on a weekend;

(b) school related overseas and interstate trips, conferences and similar activities undertaken by mutual consent during non-term weeks;

(c) when the employee appointed to a leadership position is performing duties in non-term weeks that are directly associated with the leadership position;

(d) when the employee has boarding house responsibilities and the employee is performing those duties during term weeks and non-term weeks; and

(e) exceptional circumstances, such as the requirement to provide pastoral care to students in the event of a tragedy in the school community, in which an employee may be recalled to perform duties relating to their position.

If an employee is required to work in any of the above duties and the time should not contribute to the calculation of attendance days the shift tag Additional Duties can be applied to the shift.

When the Additional Duties tag is applied in the timesheet, the shift will calculate as non-ordinary and subsequently will not contribute towards the count for the employee's maximum attendance days. The time worked as Additional Duties will be paid at the employee's normal hourly rate.

Please see the example below:

Before the Additional Duties tag is applied:

After the Additional Duties tag is applied:

Clause 15.5 does not apply to employers that adhere to the school or calendar year of a foreign country. For further details on how to manage this please see here.

Teachers in Early Childhood Services - 48 Week Operation

Under the Educational Services (Teachers) Award, teachers in early childhood services that operate for at least 48 weeks will be paid overtime for all authorised work performed outside or in excess of the ordinary or rostered hours.

Overtime will be paid for at 150% of the minimum hourly rate for the first 3 hours and 200% of the minimum hourly rate thereafter.

The application of overtime is detailed in A.4.1(a) of Schedule A.

📜 A.4.1 Overtime rates

Time off in lieu (TOIL)

When an employee has an agreement with their employer that overtime worked that would have otherwise been paid for can be accrued as time off, they are agreeing to Time Off In Lieu (TOIL).

The Educational Services (Teachers) Award Managed Template contains TOIL conditions that can be applied instead of automatic overtime conditions in accordance with A.4.2 of Schedule A.

(a) An employee and employer may agree in writing to the employee taking time off instead of being paid for a particular amount of overtime that has been worked by the employee.

(b) Any amount of overtime that has been worked by an employee in a particular pay period and that is to be taken as time off instead of the employee being paid for it must be the subject of a separate agreement under clause A.4.2.

...

(d) The period of time off that an employee is entitled to take is the same as the number of overtime hours worked.

EXAMPLE: By making an agreement under clause A.4.2 an employee who worked 2 overtime hours is entitled to 2 hours’ time off.

(e) Time off must be taken:

(i) within the period of 6 months after the overtime is worked; and

(ii) at a time or times within that period of 6 months agreed by the employee and employer.

To categorise time worked as TOIL in Tanda, the shift must be tagged as TOIL so that time off is accrued instead of overtime rates being paid.

Overtime hours that have the TOIL tag applied will no longer cost in the timesheet.

⚡️ The TOIL Accrual Report can be used to track and report on TOIL Accruals and TOIL Expiry.

Please see the below example of TOIL applying in the timesheet.

Please see the below example where some of the available shift tags are being added to the employee profile.

Then from the drop-down, select the manual allowance you wish to apply:

Enter the number of units you wish to apply then press the blue Save Allowances button to apply the allowance to the timesheet. Tanda will calculate the total cost of the allowance for you.

⚡️ If you need to apply the allowance for a part time employee on a proportionate basis based on the number of hours worked, enter a decimal into the units field according to the percentage of full time hours worked by the part time employee.

Once saved, the allowance will now apply to the day's timesheet:
