Further automation of the missed meal break penalty during overtime
Further automation of the missed meal break penalty during overtime
The Fitness Industry Award outlines that if an employee is unable to take an unpaid meal break they are to be paid penalty until a meal break can be taken or a shift ends.
π 14. Breaks
14.1 Unpaid meal break
(a) An employee must be given an unpaid meal break of between 30 minutes and 60 minutes no later than 5 hours after commencing work and 5 hours after the resumption of work from a previous meal break.
(b) An employee required to work through a meal break must be paid 200% of the minimum hourly rare for all time so worked until a meal break is allowed.
The Fitness Industry Award Managed Template now contains further automation of the missed meal break penalty during overtime periods.
Prior to this update, the missed meal break penalty award rules in the Fitness Industry Managed Template were automated during ordinary hours.
Now, the missed meal break penalty will be treated as ordinary hours or overtime based on the award conditions that would have otherwise applied to the time worked.
NOTE: There is no change to the application of the missed meal break penalty during ordinary hours. These conditions already operated automatically.
In the below example, the employee has worked 9.5 hours and has not taken an unpaid meal break.
The employee commences their shift in ordinary time and the missed meal break penalty automatically applies from the 5th hour of work. The employee then subsequently enters an overtime period for working in excess of 38 ordinary hours in their timesheet period. The employee is still paid the missed meal break penalty, however this time is now treated as overtime:
Further automation of minimum engagements during overtime
Further automation of minimum engagements during overtime
The Fitness Industry Award Managed Template now contains further automation of minimum engagements during overtime periods.
If a minimum engagement applies and the employee has not met the required minimum shift length, the timesheet will now automatically buffer the shift to the required length at the rate that would have otherwise applied if the employee had worked the minimum engagement period.
For example, if a part time employee is working a shift outside of their regular hours of work that does not meet the required minimum shift length, the minimum engagement will buffer at the overtime rates that would have applied to the time worked:
NOTE: There is no change to the application of minimum engagements during ordinary hours or outside the span of ordinary hours. These minimum engagement periods already operated automatically.
For further details on the minimum engagement periods that apply under the Fitness Industry Award Managed Template, please see the {LINK} section of the Managed Template Summary Guide.
