Further automation of minimum engagements during overtime

The Registered and Licensed Clubs (Maintenance) Managed Template now contains further automation of the minimum engagement periods that apply under the Award.

Part Time

📜 10.7(b) must not be rostered to work in excess of 12 or fewer than 3 hours in any one day; and

Casual

📜 11.5 A casual employee (other than a casual employee engaged solely as a bingo caller, assistant bingo caller or fitness instructor) is entitled to a minimum payment for 2 hours’ work on each occasion that they are required to attend work. ...

Public Holidays

📜 24.3(a) An employee other than a casual employee working on a public holiday will be paid for a minimum of 4 hours’ work. Hours of work performed immediately before or after a part-day public holiday, that form part of one continuous shift, are counted as part of the minimum payment/engagement period.

The timesheet will now automatically buffer the shift to the required length based on the rate that would have otherwise applied if the employee had worked the required minimum engagement period.

For example, if an employee is works outside their rostered hours, the minimum engagement will apply per the below:

Time off In Lieu (TOIL) now available

When an employee has an agreement with their employer that overtime worked that would otherwise have been paid for can be accrued as time off instead, they are agreeing to Time Off In Lieu (TOIL).

The Registered and Licensed Clubs (Maintenance) Award Managed Template now contains TOIL conditions that can be applied instead of automatic overtime conditions per clause 22.8:

📜 22.8 Time off instead of payment for overtime

(a) An employee and employer may agree in writing to the employee taking time off instead of being paid for a particular amount of overtime that has been worked by the employee.

(b) The period of time off that an employee is entitled to take is equivalent to the overtime payment that would have been made.

EXAMPLE: By making an agreement under clause 22.8 an employee who worked 2 overtime hours at the rate of 150% is entitled to 3 hours’ time off.

(c) Time off must be taken:

(i) within the period of 6 months after the overtime is worked; and

(ii) at a time or times within that period of 6 months agreed by the employee and employer.

To categorise time worked as TOIL in Tanda, the shift must be tagged with the TOIL shift tag so that the time off is accrued instead of overtime rates being paid.

The overtime hours that have had a TOIL tag applied to them will no longer cost in the timesheet.

Automation of Broken Work Periods Allowance

📜 19.2(c) Broken periods of work allowance

An employee (other than a casual employee) who is required to work any of their ordinary hours on any day in more than one period of employment, other than for meal breaks in accordance with the provisions of clause 17—Meal breaks, will be paid an allowance of $4.27 per day, for the broken work period worked.

The Broken Work Periods Allowance in the Registered and Licensed Clubs (Maintenance) Managed Template has historically required manual application in the timesheet.

The Broken Work Periods Allowance has now been updated to automatically apply when an employee has works their ordinary hours in more than one period separated by more than 30 minutes. This automation is based on clauses 17.1(a) and 19.2(c) of the Award.

Please see the below example where an employee has worked ordinary hours across more than one period in a day:

Updates to First Aid Allowance

📜 19.2 Wage-related allowances

(a) Allowances paid for all purposes are included in the rate of pay of an employee who is entitled to the allowance, when calculating any penalties or loadings or payment while they are on annual leave. The following allowance is paid for all purposes under this award:

(i) First aid allowance (clause 19.2(b)).

(b) First aid allowance

An employee who has undertaken a first aid course and who is the holder of a current recognised first aid qualification such as a certificate from the St John Ambulance or similar body and who is appointed by the employer as a first aid attendant must be paid an allowance of $12.82 per week. This amount will be paid for all purposes.

The First Aid Allowance in the Registered and Licensed Clubs (Maintenance) Managed Template has historically been automated and have applied on an hourly basis.

The First Aid Allowance has been updated to include new functionality to automate the application of the allowance for all purposes. This automation is based on clauses 19.2(a) and 19.2(b) of the Award.

This means the allowance will now apply in addition to the base hourly rate and will incur the same multiplier as the time worked.

For example, if an employee receives the First Aid Allowance and works 5 hours of overtime, the First Aid Allowance will apply per the below:

Breakdown of all purpose rate:

The employee has worked 2 hours of overtime at 150% and 3 hours at 200%.

The First Aid Allowance has applied 9 units (2 x 1.50 + 3 x 2.00) of the allowance rate to reach the all purpose rate.
