Overview of Managed Template Updates

The updates to the Registered and Licensed Clubs (Maintenance) Managed Template have been made to further reflect the conditions set out for maintenance and horticultural employees.

The specific ordinary hours conditions for maintenance and horticultural employees are set out under clause 15.6 of the Clubs Award:

πŸ“œ 15.6 Special provisions for maintenance and horticultural employees

(a) For maintenance and horticulture employees the ordinary hours will be worked between the hours of:

(i) 6.00 am and 6.00 pm Monday to Friday; and

(ii) 6.00 am and 12.00 noon on Saturday.

(b) The span of hours may be increased up to one hour by agreement between the employer and the majority of employees.

(c) The maximum number of ordinary hours worked on any one day will not exceed 8 hours on Monday to Friday and 4 hours on Saturday.

In the Tanda Clubs (Maintenance) Managed Template, overtime rates will automatically apply for any hours worked outside or in excess of the conditions outlined above.

Updates have been made to the Clubs (Maintenance) Managed Template to further facilitate clause 15.6 of the Award and the differing penalty periods set out in clause 24.2.

Addition of shift tags to facilitate ordinary hours penalties on weekends

Clause 15.6(a) of the Clubs Award outlines that ordinary hours for maintenance and horticultural employees can only be worked between:

  • 6.00am to 6.00pm on weekdays; and

  • 6.00am to 12.00pm on Saturdays.

By default in the Clubs (Maintenance) Managed Template, any hours worked outside of the span of hours is paid at the overtime rates set out under clause 22.3:

πŸ“œ 22.3 The following overtime rates are payable to an employee, depending on the time at which the overtime is worked:

(a) Monday to Friday: 150% of the ordinary hourly rate of pay for the first 2 hours and 200% after 2 hours;

(b) between midnight Friday and midnight Saturday: 175% of the ordinary hourly rate of pay for the first 2 hours and 200% after 2 hours;

(c) between midnight Saturday and midnight Sunday: 200% of the ordinary hourly rate of pay for all time worked;

(d) public holiday: 250% of the ordinary hourly rate of pay for all time worked, with a minimum payment of 4 hours. Hours of work performed immediately before or after a part-day public holiday, that form part of one continuous shift, are counted as part of the minimum payment/engagement period;

(e) rostered day off: 200% of the ordinary hourly rate of pay for all time worked, with a minimum payment of 4 hours.

Clause 24.2 of the Clubs Award outlines that ordinary hours penalty rates can be applied outside of the span of ordinary hours for maintenance and horticultural employees:

Saturday Ordinary After 12 Noon

The shift tag Saturday Ordinary After 12 Noon can be applied to shifts when it is appropriate to pay ordinary hours penalties after 12.00pm on a Saturday.

Sunday Ordinary Hours

The shift tag Sunday Ordinary Hours can be applied to shifts when it is appropriate to pay ordinary hours penalties on a Sunday per clause 24.2.

Note: The public holiday ordinary hours penalty automatically applies when the employee works within the span of ordinary hours on a public holiday.

Updates to overtime conditions for casual employees

Previously, the daily overtime threshold for casual maintenance and horticultural employees was set to 12 ordinary hours per clause 11.4(a) of the Clubs Award.

The daily overtime for casual maintenance and horticultural employees has been updated to reflect clause 15.6(c).

(c) The maximum number of ordinary hours worked on any one day will not exceed 8 hours on Monday to Friday and 4 hours on Saturday.

Daily overtime will now trigger for casual employees after:

  • 8 ordinary hours on weekdays; and

  • 4 ordinary hours on Saturdays.

NOTE: Time worked on a Sunday is automatically paid at overtime rates by default for maintenance and horticultural employees per clause 15.6(a).
