Not sure which rules apply, what level to classify staff, or whether the award applies to all your staff?
You can speak with an industrial relations expert from our Employment Advisory service, who can provide guidance on your obligations under the Manufacturing Award.
Employee Classifications
To ensure that the correct rules pull through, you must make sure that the correct classification is tagged on your employee’s profile. Below is the list of employee classifications, go through and select the correct one.
Award Tags
There are also some shift conditions that can only work if you tag them within the employee profile and on the timesheet. Below are the tags:
Missed Meal Break (this must be tagged on all employees’ profiles)
An employee must not be required to work for more than 5 hours without an unpaid meal break of a minimum of 20 minutes. If an employee must work during meal breaks, the employee must be paid as follows for all work done during meal hours and thereafter until a meal break is taken:
(i) except in circumstances referred to in clauses 18.5(b)(ii),(iii) and (iv): 150% of the ordinary hourly rate;
(ii) where the unpaid meal break is during ordinary time on a Saturday or Sunday: 200% of the ordinary hourly rate;
(iii) where the unpaid meal break is during ordinary time on a shift on which the employee is entitled to a 15% loading: 165% of the ordinary hourly rate;
(iv) where the unpaid meal break is during ordinary time on a shift on which the employee is entitled a 30% loading: 180% of the ordinary hourly rate.
Example: If your employee has an 8:00-17:00 shift, they must have taken their break, at the latest, by 13:00. If they have not taken a break by 13:00, they are entitled to the relevant overtime rates from 13:00 onwards, until they have taken their break or until their shift ends.
If they have not taken their break until their shift ends, then on your timesheet you must clock 8:00-13:00, and then create a separate shift of 13:00-17:00 that gets tagged with ‘Missed meal break’. In that way, your employee is paid from 13:00-17:00 at the correct overtime rates.
The same applies for if your employee doesn’t take their break until later at 14:00. You must clock 8:00-13:00, then create a second shift to clock 14:00-15:00 that is tagged with ‘Missed meal break’, and then create a third shift to clock 15:30-17:00 for the remainder of their shift. Remember to make sure that the break time is set to 0.
See images below on how to do this:
Navigate to the employee’s timesheet.
2. Click on the small + button on the left of the timebar (underneath the rubbish bin) to create a secondary shift on the same day and then fill out the timesheet with 8:00-13:00 and 13:00-17:00 respectively.
3. Notice how the missed meal break rule is not pulling through yet. This is because the second shift must be tagged for the rule to pull through correctly. So click the drop down labelled ‘Select Tag’ and you will see a list of tags.
4. Choose ‘Missed meal break’ and the relevant rule will pull through and apply the relevant overtime rates.
5. Click refresh and scroll down to the bottom of the page to make sure that the correct rule has applied and is paying correctly.
Less 5 Successive (this must be tagged on all shiftworker employees’ profiles)
An employee who works on an afternoon or night shift which does not continue: (i) for at least 5 successive afternoon or night shifts or 6 successive afternoon or night shifts in a 6 day workshop (where no more than 8 ordinary hours are worked on each shift);or (ii) for at least 38 ordinary hours, must be paid for each shift 150% of the ordinary hourly rate for the first 3 hours and 200% of the ordinary hourly rate for the remaining hours.
To ensure the correct rates pull through, the shift on the timesheet must be tagged with ‘Less 5 Successive’.
Example: If your employee works an afternoon shift from 8pm-midnight which does not continue for at least 5 successive afternoon shifts, then they must be paid the rate mentioned above. To do this, refer to the images below.
Navigate to the employee’s timesheet.
2. Click on the ‘Select Tag’ dropdown and select ‘Less 5 Successive’.
3. The relevant rate should pull through.
Call Back (this must be tagged on all employees’ profiles)
An employee recalled to work overtime after leaving the employer’s business premises (whether notified before or after leaving the premises) will be paid for a minimum of 3 hours work at the appropriate rate for each time recalled; provided that, except in the case of unforeseen circumstances arising, the employee will not be required to work the full 3 hours if the employee was recalled to perform work which is completed within a shorter period. This rule does not apply where (i) it is customary for an employee to return to an employer’s premises for periods not exceeding 30 minutes each to perform a specific job outside the ordinary working hours in which case the employee will be paid for a minimum of one hour’s work at the appropriate rate for each time recalled; or (ii) where the overtime is continuous (subject to a reasonable meal break) with the commencement of ordinary working time.
To ensure the correct rates pull through, the shift on the timesheet must be tagged with ‘Call Back’. Refer to the above images on how to tag a shift on the timesheet.
Standing By (this must be tagged on all employees’ profiles)
Where an employee is required regularly to hold themselves in readiness to work after ordinary hours, the employee must be paid standing by time at the employee’s ordinary hourly rate for the time they are standing by.
To ensure that the correct rates pull through, the shift on the timesheet must be tagged with ‘Standing By’. Refer to the above images on how to tag a shift on the timesheet.
